PLEASE READ THE FOLLOWING TERMS AND CONDITIONS BEFORE USING ANY OF THE AUDIO CONTENT FOUND ON OUR WEBSITE AND/OR INCLUDED IN OUR CD/DVD COLLECTIONS. BY USING THE CONTENT (OPENING THE CD/DVD PACKAGING OR CLICKING 'ACCEPT ON OUR WEBSITE) YOU ARE ACCEPTING SUCH TERMS AND CONDITIONS. IF YOU DO NOT AGREE WITH THE TERMS OF THE LICENSE AGREEMENT, DO NOT OPEN THE CD/DVD PACKAGE OR USE ITS CONTENT, AND/OR CLICK 'DECLINE' IF ON-LINE TO EXIT THE PROGRAM.
1. Ownership. The enclosed music and audio content (the "Content") master recording(s) and underlying musical composition(s) is the copyrighted property of KMP and is licensed non-exclusively (not sold) to you solely for the described uses below. KMP guarantees that the content from KMP music library/store has been created and recorded specially for its named collections or volumes, and any similarity to any other recording is unintentional. Such ownership interests are protected by U.S. and international copyright laws.
2. (Basic) Limited License. FOR ROYALTY-FREE, ORIGINAL MUSIC.
You may adapt, reproduce, synchronize, and distribute the Content only in conjunction with and as an integral part of visual media works and/or audio content presentations containing voice-over, narration or spoken word, created, adapted, edited or synchronized by you utilizing (your "Production") and you may authorize others to perform, transmit, distribute or otherwise disseminate your Production in the following uses. You are not required by this license to pay broadcast fees or royalties with respect to any use or broadcast of your Production, the license granted herein is a Direct license to you. Should you broadcast you Production simply send us a 'cue sheets' for record keeping.
YOU MAY USE OUR ROYALTY-FREE SAMPLES FOR:
Broadcast:
Film festival entries (Short Films and/or documentaries)
Internet Streaming, Podcast, Vodcast (Project Budget Under 50k)
Use our music in public venue presentations, on-hold systems and up to 10 retail locations.
Low Budget Internet advertising (Project Budget Under 50k)
Local & Regional TV, Cable/Sat, Radio (Project Budget Under 50K)
This is a direct license, however, CUE SHEETS are required if using music content for
broadcasting on local & regional TV, Cable/Sat, and/or radio (for documentation purposes
only) Email copy of Cue Sheet to info@kingofkingsrecords.com .
Reproduction: Up to 5,000 Videograms/Downloads (DVD, Video Cassette etc.)
A Duration of : Up to 3 Years use in an advertisement, TV Show, Film etc.
Promotional Activities: ancillary rights, merchandising rights, cross-promotions, and commercial tie-ins connected with the Production, including, Electronic Press Kits (EPKSs), promotions, merchandising, supplementary marketing and other commercial exploitation.
YOU MAY NOT: without obtaining an additional license from KMP, (a) adapt, synchronize, reproduce and distribute the Content as part of:
A Production wherein a distributor replicates more than 5,000 copies
National television exhibited on theme-based cable and/or satellite providers (ex: Food
Network, HGTV, Discovery, Animal Planet, National Geographic, E!, USA Network, etc.)
A national televised broadcast through a major television network or cable company
(ex: ABC, NBC, CBS, Fox, HBO, Showtime, Cinemax, AMC, ESPN, CNN, etc.)
A major theatrical feature film release exhibited nationally in public commercial theaters
(thats not part of a film festival)
A Production performed in theaters or broadcast on television in more than one country
A Production wherein a distributor, performs, transmits or distributes any Content separately
from or for any other purpose not contained in your Production.
Copy or publish any Song to a network or bulletin board, Sublicense, re-license, rent or lease
any song separately from your Production
Use any Song in connection with any form of pornography
Use any Song in a libelous, defamatory, fraudulent , infringing or otherwise illegal manner
Use any song to promote a business that sells or licenses Songs, or otherwise competes with
KMP in any manner
Ship, transfer or export any of the Songs into any country or use any of the Songs in any manner prohibited by any export laws, restrictions or regulations.
3. Warranty. KMP warrants the Content media to be free from defects in materials and workmanship for a period of sixty (60) days from the date of purchase. KMP will replace any such defective media returned to KMP during such warranty period, provided such defect is not the result of improper use or neglect, or if KMP is unable to do so, it will refund your price for such defective Content. Replacement (or refund) is the exclusive remedy for any such defects, and KMP shall have no liability for any other damages.
4. Termination. This Agreement is effective until terminated. You may terminate it at any time by destroying the original media copy of the Content and removing or erasing all copies of the Content and your Production (the Content used in your production) in your possession or control. This Agreement also will terminate if you do not comply with any terms or conditions of this Agreement.
5. Agreement. This Agreement expresses the entire understanding between you and KMP, and supersedes all other oral or written communications relating to the Content. This Agreement shall be governed and construed under the laws of the State of Texas and subject to the exclusive jurisdiction of the courts Harris County, Texas.
Federal law provides severe civil and criminal penalties for the unauthorized reproduction, distribution and exhibition of copyrighted music or audiotapes, discs or other media. Copyright infringement is investigated by the FBI and may constitute a felony with a maximum penalty of up to five years in prison and/or $250,000 fine.
